A trio of Florida attorneys has filed a federal lawsuit against Apple Inc. for including the expiration date of credit cards on receipts issued by its Web store. According to the attorneys, federal law prohibits using more than the last five digits of a credit card and the card expiration date on a receipt. The lawsuit was filed on behalf of all consumers, and the attorneys are asking for at least $100 but not more than $1,000 for each violation, in addition to attorneys’ fees. Apple’s retail stores are not implicated in the lawsuit, since their e-mail and printed receipts do not include the prohibited data [example]. The lawsuit claims the credit card data “recklessly” subjects customers to identify theft and fraud, although it admits that any loss is “small and difficult to quantify.” The lawsuit is one of many class-actions filed around the country by law firms, ostensibly on behalf of aggrieved consumers. In this case the plaintiffs are a Miami Beach husband-wife chiropractor team who purchased iPods and Quicktime from Apple’s Web store, and a woman who purchased an iKlear screen cleaning kit. Well another group of non-Mac fans who want a bite of the big Apple….
I have been shopping at Apple Stores throughout Florida since 1991 and I have never had this issue come up.
Oh Vey!
Ah, yes! Another class action lawsuit, which is of course designed to enrich lawyers… The joy of living in the most litigious country in the world.
Does the law not say “print”? Apple never printed these receipts.
The lawsuit makes no sense. You have to have an account and sign-in to buy from the Apple Store. Therefore, you have to be signed in to print out a receipt. The only security risk is if you kept a copy of your receipt on your desk at work and someone saw your credit card #, but that’s like suing a credit card company because you stupidly left your wallet on the desk.
And I agree. Only lawyers get money from class action lawsuits. For stocks that I own, I get copies of lawsuit notices all the time. If you’re lucky, you get 7 to 10 cents a share. The lawyers get $100 million. They’re not even worth my time to file for the supposed benefit.
